Terms of Service
Last updated: April 2026
1. Acceptance of Terms
By accessing or using the Better Health Now website (betterhealthnow.com) and related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services. Your continued use of the Services after any changes to these Terms constitutes acceptance of those changes.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age.
- Be a legal resident of the United States.
- Reside in a state where our telehealth services are available. Service availability varies by state based on telehealth regulations and provider licensing.
- Provide accurate and complete information during registration and throughout the intake process.
- Have the legal capacity to enter into a binding agreement.
3. Description of Services
Better Health Now is a telehealth platform that connects patients with licensed physicians for the purpose of evaluating, diagnosing, and prescribing treatments including peptide therapy, GLP-1 weight loss medications, and other wellness treatments. Our services include:
- Online medical intake questionnaires reviewed by licensed physicians.
- Physician-supervised treatment plans tailored to individual patient needs.
- Prescription fulfillment through our 503A licensed pharmacy partners.
- Ongoing care coordination and prescription management.
Important Limitations
- Our Services are not intended for emergency medical situations. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
- Telehealth consultations do not replace your relationship with your primary care physician. We encourage you to inform your primary care provider about any treatments prescribed through our platform.
- A physician may decline to prescribe a treatment if, in their clinical judgment, it is not appropriate for your medical situation.
4. Account Responsibilities
When you create an account with Better Health Now, you agree to:
- Provide truthful, accurate, and complete information, including your medical history, current medications, and health conditions.
- Maintain the confidentiality of your account credentials and not share your login information with others.
- Notify us immediately if you suspect unauthorized access to your account.
- Accept responsibility for all activities that occur under your account.
- Keep your contact and shipping information up to date.
Providing false or misleading medical information may result in inappropriate treatment, which could pose serious health risks. Better Health Now reserves the right to suspend or terminate accounts where inaccurate information has been provided.
5. Payment and Refund Policy
Payment
- All prices are displayed in US dollars and are inclusive of the costs listed at checkout.
- Payment is required at the time of order placement.
- We accept major credit cards and debit cards. Payment processing is handled by secure third-party payment processors.
- Better Health Now operates on a direct-pay model. We do not bill insurance directly, but you may submit itemized receipts to your insurance provider for potential HSA or FSA reimbursement.
Refunds and Cancellations
- If your physician determines that a prescribed treatment is not appropriate for you, the medication and shipping charges for that treatment are refunded in full. Where a separate physician review fee was charged, that fee is not refunded, because the review was performed.
- Once a compounded medication has been prepared and shipped, it cannot be returned or refunded due to the custom nature of compounded pharmaceuticals.
- You may cancel a subscription at any time. Cancellation will take effect at the end of your current billing cycle.
- Refund requests for other circumstances will be evaluated on a case-by-case basis. Contact our support team for assistance.
6. Intellectual Property
All content on the Better Health Now website, including text, graphics, logos, images, software, and design elements, is the property of Better Health Now or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without our prior written consent. The Better Health Now name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Better Health Now. You may not use these marks without our prior written permission.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Better Health Now, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising out of or related to your use of (or inability to use) our Services.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to Better Health Now in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
8. Disclaimer of Warranties
Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Better Health Now does not warrant that the Services will be uninterrupted, error-free, or secure. While our physicians provide medical care consistent with accepted standards of practice, individual results from treatments vary and cannot be guaranteed.
9. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall first be addressed through good-faith negotiations between you and Better Health Now. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration will take place in the State of New York, and the arbitrator's decision will be final and binding. Each party shall bear its own costs, and the arbitration fees will be shared equally unless the arbitrator determines otherwise.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action. These Terms and any disputes arising hereunder shall be governed by the laws of the State of New York, without regard to its conflict-of-law provisions.
10. Indemnification
You agree to indemnify, defend, and hold harmless Better Health Now, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, your provision of inaccurate medical information, or your violation of any third-party rights.
11. Termination
We may suspend or terminate your account and access to our Services at any time, with or without cause, and with or without notice. You may close your account at any time by contacting our support team. Upon termination, your right to use the Services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you through the Services or by email. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
13. SMS / Text Messaging Terms
These SMS Terms govern transactional text messages sent by Better Health Now LLC ("we," "us," or "our") to mobile phone numbers that have opted in, either through a treatment assessment on this site or through our patient intake form. By providing your mobile number and checking the SMS consent box, you agree to these SMS Terms in addition to the rest of these Terms of Service.
Program description. Better Health Now sends you transactional text messages about your account, prescriptions, orders, shipping, appointments, and care coordination. If you opted in through a treatment assessment, that also includes a follow-up with the results of the assessment you asked us for. We do not send marketing or promotional messages through this program.
Frequency. Message frequency varies by account activity, with a typical maximum of 5 messages per month per enrolled patient.
Phone calls. The consent box on a treatment assessment also covers phone calls, which may be placed using automated technology. We call to review the results of the assessment you asked us for, to answer questions about treatment, and to follow up on an order or prescription. We do not place telemarketing calls to numbers we did not obtain this way. Consent to calls is not a condition of purchase, and you can ask us to stop calling at any time by telling the caller, by replying STOP to a text, or by emailing hello@betterhealthnow.com.
Cost. Message and data rates may apply, depending on your wireless carrier and plan. Better Health Now does not charge for SMS messages it sends; charges come from your carrier.
Carriers. The program is supported by major US carriers including AT&T, Verizon, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.
Opt-out. You may opt out at any time by replying STOP to any message you receive from us. After you reply STOP, we will send a confirmation message and will not send further texts unless you opt back in.
Help. Reply HELP to any message for assistance, or contact hello@betterhealthnow.com.
Eligibility. The SMS program is available only to US-based patients age 18 and older. By opting in you represent that you are the account holder or authorized user of the mobile number provided.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
